Discrimination Complaints

The best approach to minimizing employee misconduct and the resulting financial risks and legal exposures to your company is to establish programs that will prevent employee misbehavior and/or discrimination. Well designed programs must include the appropriate responses if and when employee misconduct occurs. Information regarding government audits can be found under “Audit Response.” 

In conjunction with Fortney & Scott, LLC, WorkPlace HR offers services directed at handling complaints, including:

  • Developing discrimination and harassment policies
  • Recognizing and responding to the early warning signs of potential employee problems
  • Designing and effectively deploying robust internal complaint processes
  • Responding to internal employee complaints and working with you to resolve issues and disputes while protecting the legal rights of all involved
  • Developing a strategy for responding to EEOC or other government agency charges
  • Conducting an investigation, and identifying and reviewing the appropriate business records and employment policies
  • Preparing an effective position statement for you to submit in response to the charge
  • Assisting in the preparation of an on-site investigation
  • Responding to mediation requests as the agency attempts to conciliate charges
  • Developing a strategy to minimize chances of successful retaliation claims
  • Adapting existing training programs or developing new ones in discrimination and/or harassment prevention

The law requires that those who serve their country retain their civilian employment and benefits, and can seek employment free from discrimination because of their service.

In conjunction with Fortney & Scott, LLC, WorkPlace HR offers services directed at providing guidance to employers with relation to Uniformed Services Employment and Reemployment Rights Act (USERRA), including:

  • Developing policies that cover employment and reemployment rights and employer obligations
